Terms of Service

By accessing or using Nark (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Service Description

Nark is a code analysis tool that scans TypeScript repositories to identify unhandled package behaviors using Nark Profiles. The Service includes:

  • Nark CLI — a free, open-source command-line tool that runs locally on your machine or CI environment
  • Nark Cloud — an optional paid dashboard for tracking scan results, trends, and team collaboration

We provide reports and analysis. We do not modify your code.

2. Accounts

To use Nark Cloud, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activity that occurs under your account.

You must be at least 18 years old to create an account. By creating an account, you represent that the information you provide is accurate and complete.

3. Acceptable Use

You agree to:

  • Use Nark only for repositories you own or have explicit authorization to analyze
  • Not use the Service for any unlawful purpose
  • Not attempt to reverse-engineer, decompile, or extract the source code of the Nark Cloud platform (the CLI is open source)
  • Not interfere with or disrupt the Service or its infrastructure
  • Not share your API key with unauthorized parties

4. Open Source CLI

The Nark CLI is open-source software distributed under its own license (see the GitHub repository for details). Your use of the CLI is governed by that license. These Terms of Service apply specifically to the Nark Cloud platform and nark.sh website.

5. Payments & Billing

Paid plans are billed monthly or annually as selected at signup. All fees are non-refundable except where required by law. We may change pricing with 30 days' notice to existing subscribers.

Per-seat plans (Teams and Enterprise). When an organization administrator subscribes to a per-seat plan, the subscription is billed at the published or agreed per-seat rate multiplied by the current number of accepted members. By subscribing, the administrator authorizes Nark to adjust the billed quantity as members are added (when invitations are accepted) or removed (when members are removed from the organization). Quantity changes are prorated for the remainder of the current billing cycle: additions create a prorated debit and removals create a prorated credit, both reflected on the next invoice. The administrator can view all current and historical line items, including prorations, via the Stripe Customer Portal accessible from the in-app Billing settings.

If payment fails, we will attempt to charge your payment method again. If payment remains outstanding for 14 days, your account may be downgraded to the free tier.

6. Intellectual Property

You retain all rights to your code and repositories. Nark does not claim any ownership over your source code or scan results. The Nark brand, website design, cloud platform, and Nark Profile library (excluding open-source components) are our intellectual property.

7. Data & Privacy

Our collection and use of data is governed by our Privacy Policy. By using the Service, you agree to the data practices described therein.

Key point: the Nark CLI runs locally. Your source code is never uploaded to our servers. See our Privacy Policy for details on what telemetry data is collected when using an API key.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranty of any kind, express or implied. We do not guarantee that:

  • Scan results are complete or free from false positives
  • The Service will be uninterrupted or error-free
  • All package behaviors are covered by existing Profiles

Always exercise your own judgment when reviewing scan results. Nark is a supplementary tool, not a replacement for code review, testing, or security audits.

9. Limitation of Liability

To the maximum extent permitted by law, Nark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these terms or engage in activity that is harmful to the Service or other users.

Upon termination, your right to use Nark Cloud ceases immediately. We will delete your telemetry data within 30 days of account closure, as described in our Privacy Policy.

11. Changes to These Terms

We may modify these terms at any time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
